Welcome to Baby Studio 4D. These Terms of Service ("Terms") govern your use of our website (babystudio4d.com) and the services we provide at our studio in Raleigh, NC. By booking a session, making a purchase, or using our website, you agree to these Terms.

Accepting these terms

These Terms are a binding agreement between you ("you," "your," or "Client") and Baby Studio 4D ("we," "us," "our," or "Studio").

You confirm that you are at least 18 years old, or that you are accessing the site or booking a session with the consent of a parent or legal guardian. If you do not agree with any part of these Terms, please do not use our services.

Nature of our services

Baby Studio 4D is a keepsake imaging studio. We provide non-diagnostic 2D, 3D, 4D, and HD ultrasound sessions designed for personal, emotional, and family connection — not for medical evaluation.

Booking & payment

How to book

Sessions are booked through our online portal powered by Square, by phone, or in person. A session is confirmed when you receive confirmation from Square or directly from us.

Pricing

All prices are in U.S. dollars and listed below. Prices are subject to change; the price displayed at the time you book is the price you pay.

Payment

Payment is collected at the time of booking through Square. We accept credit and debit cards, Apple Pay, gift cards, and (in studio) cash. Sales tax is added at checkout where applicable.

Cancellation & rescheduling

Life with a growing baby can be unpredictable. Our policy is designed to be fair to both you and our small team:

• More than 24 hours before your session: reschedule for free, or cancel for a full refund.
• Less than 24 hours before: you may reschedule once at no cost. Cancellations are non-refundable but may be converted to a studio credit valid for 6 months.
• No-show: sessions where you do not arrive and do not contact us are not refundable.

If we need to cancel

In the rare event we must cancel (equipment issue, illness, weather), we'll contact you as soon as possible. You can choose to reschedule at no cost or receive a full refund.

During your session

What to expect

• Plan to arrive 5–10 minutes before your session.
• You may bring up to 4 guests, including children — our private suite welcomes the whole family.
• Hydration and a light meal 30 minutes before your session help imaging quality. See our Hydration Guide.

If imaging is not clear

Imaging quality depends on baby's position, amniotic fluid, and other factors we cannot control. If we cannot achieve clear imaging during your session:

• You receive a complimentary 15-minute "comeback" session within 14 days, at no cost.
• This applies regardless of the package booked.

Gender determination

Where included in your package, gender determination is approximately 99% accurate based on visible anatomy. We cannot guarantee accuracy, and we recommend confirming with your healthcare provider for any decisions that depend on it.

Photos, videos & media rights

Your media is yours

The session media included in your package — printed photos, digital images, and video clips — are yours to keep, share, print, and use however you wish for personal purposes.

Studio retention

We archive a copy of your session media for 30 days after delivery, then delete it from our active systems.

Use in our marketing — only with consent

We may ask permission to use anonymized clips or images from your session in our social media, website, or educational content. This is always optional. You can:

• Decline at the time of your session (uncheck the consent box).
• Withdraw consent later by emailing Angie@babystudio4d.com — we'll remove published content within 14 days.

Right to refuse service

We reserve the right to refuse, cancel, or terminate a session at our reasonable discretion for legitimate, non-discriminatory reasons, including but not limited to:

• The client or a guest is disrespectful, threatening, or intoxicated
• The session would compromise staff or client safety
• The client provides false information when booking
• Equipment is unsafe or unavailable
• The client has an active contagious illness

We do not refuse service based on race, color, national origin, sex, gender identity, sexual orientation, religion, age, disability, marital status, pregnancy stage, or any other characteristic protected by federal or North Carolina law. Refunds in cases of refusal are issued at our discretion consistent with this policy.

Disclaimers

Our services and website are provided on an "as is" and "as available" basis. While we work hard to deliver beautiful sessions and accurate information, we make no warranties — express or implied — about:

• The medical accuracy of session imaging (it is non-diagnostic by design).
• Specific outcomes, gender accuracy, or image clarity.
• Uninterrupted access to our website or booking system.
• The accuracy of educational content on our blog or guides.

Limitation of liability

To the fullest extent permitted by North Carolina law, Baby Studio 4D's total liability to you for any claim arising from your session or use of our website is limited to the amount you paid for the session in question.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Some jurisdictions do not allow these limitations — so the limits above apply only to the extent legally permitted.

Any claim arising from your session or use of our website must be brought within one (1) year of the event giving rise to the claim. Claims brought after that period are waived.

Force majeure

Neither party will be liable for failure or delay in performing obligations under these Terms when caused by circumstances beyond their reasonable control, including but not limited to: acts of God, severe weather (hurricanes, ice storms, tornadoes), power outages, internet outages, government action, public-health emergencies, illness of staff, or equipment failure.

If we must reschedule for force-majeure reasons, you will receive a no-cost reschedule or full refund at your choice.

Privacy Policy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also acknowledge and accept our Privacy Policy.

Electronic acceptance

By clicking "I agree," checking a box, completing a booking, or otherwise indicating acceptance through our website or booking system, you consent to enter into electronic agreements with us under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable North Carolina law. Your electronic consent has the same legal effect as a handwritten signature.

Acceptable conduct

You agree not to:

• Disrupt or disrespect our staff or other clients.
• Photograph or record our staff or other clients without permission.
• Use our services if you have a contagious illness — please reschedule.
• Misuse our website (hacking, scraping, automated bots).
• Submit false information when booking.

We reserve the right to refuse or end a session if these rules are violated, consistent with the right to refuse service in section 7.

Intellectual property

All content on our website — text, photos, video, logos, design, and code — is the property of Baby Studio 4D or our licensors and is protected by U.S. and international copyright law.

You may share links to our pages on social media. You may not copy, reproduce, or distribute our content for commercial purposes without written permission.

Governing law & disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.

Any dispute arising from your use of our services or website will be resolved in the state or federal courts located in Wake County, North Carolina, and you consent to that jurisdiction.

Before filing a claim, please contact us at Angie@babystudio4d.com with a written description of the dispute. We commit to replying within 30 days and will work in good faith to resolve the matter directly. We mean it.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be replaced by a valid provision that comes closest to the intent of the original.

Entire agreement

These Terms, together with our Privacy Policy and any specific intake or consent forms you sign at the studio, constitute the entire agreement between you and Baby Studio 4D regarding our services. They supersede all prior or contemporaneous communications, agreements, and understandings — written or oral — relating to the subject matter.

Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced on our website. Continued use of our website or services after changes take effect means you accept the new Terms.
